An Australian EOR functions as the legal employer of a worker, assuming responsibility for ensuring compliance with all employment-related regulations. This encompasses various obligations such as managing payroll, taxes, statutory benefits, employment contracts, and other related matters.
A staffing agency recruits and places workers, often for temporary or project-based roles, but the client may employ them directly. An Employer of Record (EOR) legally hires workers on behalf of another company, managing payroll, taxes, benefits, and compliance, allowing the client to engage talent without establishing a local entity.
Once the Project Agreement for the new worker is signed, Australia PEO will prepare the employment contract for execution by Australia PEO's Director and the employee. This legally binding document outlines the employment terms between the legal employer (Australia PEO) and the worker.
Australia PEO pays the employees. As the legal employer (Employer of Record), Australia PEO is responsible for:
Paying the employees' wages
Withholding and remitting taxes
Managing superannuation and other statutory obligations
Providing payslips and employment records
The client company pays Australia PEO a service fee, which includes the employee's salary, oncosts (e.g. superannuation, workers’ compensation), and administrative fees. Australia PEO then disburses payments to the employee.
